City’s Continued Contract Violations on City Heights Resulting in Costly Penalties, Fees in Ongoing Arbitration Process

Last week Judge Paris K. Kallas ruled in favor of City Heights — for the third consecutive time — in our project’s ongoing dispute with the City of Cle Elum. The decision grants City Heights the right to recovery of legal fees as the prevailing party, likely totaling more than $250,000, to be paid by the City. Kallas’s order comes on the heels of her previous arbitration rulings that the City has violated the Development Agreement, which has caused lengthy project delays over the past three years.
